1. Acceptance of Terms of Service

By accessing and using PhotoAI (the "Platform", the "Company"), you (the "User") agree to be bound by these Terms and Conditions of Use (the "Terms") and acknowledge that you have read and understood our Privacy Policy.

2. Description of the Service

The Platform offers an image generation service powered by artificial intelligence (the “Service”). Upon payment, the User will gain access to train a model and generate up to 100 images, with no time limit. Afterwards, the User may optionally purchase additional models or packages of 100 images.

3. Acceptable Use

Training images: The User represents and warrants that they either own the copyright or have explicit permission from the copyright holders for all images used to train the model. The use of third-party copyrighted images without proper authorization is strictly prohibited.

Users 18 and Older: The User declares that they are at least 18 years of age. The Platform must not be used to generate images of minors.

Personal and Legal use: The User agrees to use the generated images in a lawful and ethical manner, respecting the rights of others and all applicable laws and regulations. The use of generated images for unlawful, defamatory, discriminatory, obscene purposes, or to incite violence or infringe upon any fundamental rights is strictly prohibited.

4. Disclaimer of Liability

General Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or other intangible losses, resulting from your access to or use of the Service.

Use of Generated Images: The Company is not responsible for how the User uses the images generated through the Platform. The User bears sole responsibility for ensuring that their use of the images complies with the law and respects the rights of others.

Service Interruptions: The Company reserves the right to temporarily suspend the Service for maintenance, security, or events beyond its control, without any obligation to compensate the User for such interruptions.

5. Intellectual Property

The Platform and its contents, including software, designs, trademarks, and logos, are the exclusive property of the Company and are protected by applicable intellectual property laws. Any reproduction, distribution, modification, or other unauthorized use of these materials is strictly prohibited.

6. Payment Methods

Payments must be made using the payment methods available on the Platform. The prices and features of each plan are detailed on the website. The Company reserves the right to modify pricing and product features at any time.

7. Refund Policy

Due to the high costs associated with image generation with artificial intelligence, we are not able to offer refunds for services provided.

8. Changes to the Terms

The Company reserves the right to update or modify these Terms at any time by posting the revised version on the Platform. Users are encouraged to review these Terms periodically. Continued use of the Platform after any changes are posted constitutes acceptance of the revised Terms.
